How to handle?

Owners have the legal obligation to proactively remove the Unauthorized Building Works (UBW) in their properties and reinstate the properties in accordance with the approved plans. Individual owner with financial difficulties in carrying out the rectification works may apply for the Building Safety Loan Scheme from the Buildings Department (BD).
 
Owners’ Corporation (OC) can also institute civil proceedings against any individual owner under the DMC to stop the erection of UBW or remove UBW in common areas. The BD takes priority action against UBW which are under construction to prevent their proliferation.

  • Removal Order (Section 24)
It is served upon the registered owners of a property where UBW are located. The owners are required to remove the UBW and to reinstate the building in accordance with approved building plans.
 
 

Air Pollution Control Ordinance (Chapter 311) - Environmental Protection Department (EPD)

Owner/occupier of the premises shall hire a registered asbestos contractor to carry out the removal of the asbestos containing materials. They shall give a written notice to the EPD not less than 28 days prior to the commencement of the work.
